§ 1 Scope and Definitions
General Terms and Conditions
(1) The following Terms and Conditions apply to all business relationships between us and the customer in the version valid at the time of the order.
(2) “Customers” within the meaning of these Terms and Conditions are both consumers and entrepreneurs.
(3) Deviating, conflicting or supplementary terms and conditions of entrepreneurs shall not become part of the contract, even if known, unless their validity has been expressly agreed to in writing.
§ 2 Conclusion of Contract, Storage of the Contract Text
(1) The following provisions regarding the conclusion of a contract apply to orders placed via our online shop Novarasleep.
(2) In the event of a contract being concluded, the contract is concluded with:

(3) The presentation of goods in our online shop constitutes a legally binding offer to conclude a purchase contract. The customer accepts this offer by submitting an order for the selected goods. The purchase contract is concluded upon successful submission of the order.
(4) To place an order in our online shop, the customer completes the following steps:

Login or entry of delivery address

Selection of payment method and, if applicable, entry of a billing address different from the delivery address

Binding submission of the order by clicking “Place order with obligation to pay”

For PayPal payments, the customer is redirected to PayPal to confirm payment and then returned to our shop

For Amazon Pay payments, the customer is redirected to Amazon to confirm payment and then returned to our shop

For SOFORT payments, the customer is redirected to sofort.com to confirm payment and then returned to our shop
(5) Prior to submitting the binding order, the customer may review and correct their entries or cancel the order process by closing the browser. We confirm receipt of the order and conclusion of the contract by automated email.
(6) One-Click Upsell:
After completing a purchase using PayPal, SOFORT, Amazon Pay or Stripe, the customer may be shown additional products related to the original order. These products can be purchased immediately via a single click (“One-Click Upsell”) using the same payment method and address. No additional login or payment confirmation is required. This applies only to upsells directly following the original order.
(7) We store the contract text and send the order details and these Terms and Conditions to the customer by email. The Terms and Conditions can also be accessed at any time via our website.
§ 3 Prices, Shipping Costs, Import Duties, Payment
(1) All prices include statutory VAT and other price components. Shipping costs and possible import duties or taxes may apply additionally.
(2) Goods are shipped directly from our Chinese distributor. Due to customs regulations, the customer is the importer of record and is responsible for any applicable import duties or taxes.
(3) Available payment methods are displayed in the online shop.
(4) Credit card payments are charged on the day the order is placed.
(5) PayPal payments are processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, under PayPal’s terms of use.
(6) Amazon Pay payments are processed via Amazon Payments Europe S.C.A., Luxembourg.
(7) SOFORT payments are processed via SOFORT GmbH, a Klarna Group company.
(8) Entrepreneurs may only offset claims that are undisputed or legally established.
§ 4 Delivery, Transfer of Risk
(1) Delivery times are stated in the product description. Non-personalised goods are delivered within six weeks after contract conclusion.
(1a) For personalised products, the delivery period begins only once production readiness has been reached.
(1b) Delivery of personalised products may take several weeks and up to a maximum of ten weeks, unless otherwise stated.
(1c) Delays caused by missing or incomplete customer input extend the delivery time accordingly.
(1d) Optional previews are additional services and do not affect the start of the delivery period.
(2) For consumers, the risk passes upon delivery of the goods.
(3) For entrepreneurs, risk passes upon handover to the logistics partner.
(4) If delivery delays occur for reasons beyond our control, we may set a new reasonable delivery period or withdraw from the contract.
§ 5 Retention of Title
(1) For consumers, ownership remains with us until full payment has been made.
(2) For entrepreneurs, ownership remains with us until all claims from the business relationship have been settled.
(3) Entrepreneurs may resell goods in the ordinary course of business; claims arising therefrom are assigned to us in advance.
§ 6 Statutory Warranty Rights
(1) Statutory warranty rights apply.
(2) For consumers, warranty claims for used goods expire after one year.
(3) This limitation does not apply to claims for damages resulting from gross negligence, intent, or injury to life, body or health.
§ 6a Production and Delivery Times
(1) Stated production and delivery times are non-binding estimates.
(2) Production usually takes 2–4 weeks, but may extend to 6 weeks or longer during peak periods.
(3) No fixed delivery date is guaranteed.
§ 7 Limitation of Liability
(1) Liability for simple negligence is excluded, except for essential contractual obligations, guarantees, personal injury, or product liability claims.
(2) Liability for essential contractual obligations is limited to foreseeable damages typical for the contract.
§ 8 Right of Withdrawal (Consumers)
Consumers have the right to withdraw from the contract within 14 days without giving reasons.
The withdrawal period begins on the day the goods are received.
To exercise the right of withdrawal, the customer must notify:

Refunds will be issued within 14 days using the original payment method. Return shipping costs are borne by the customer.
The right of withdrawal does not apply to:

Sealed goods for hygiene reasons once unsealed

Personalised products (a cancellation fee of up to 50% may apply)

§ 10 Alternative Dispute Resolution
We are neither willing nor obliged to participate in alternative dispute resolution procedures.
§ 11 Online Dispute Resolution

§ 12 Contract Language, Governing Law, Jurisdiction
(1) The contract language is German.
(2) Maltese law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(3) Exclusive place of jurisdiction is our registered office, where legally permissible.
§ 13 Severability Clause
If individual provisions are invalid or unenforceable, the remaining provisions remain unaffected.
